1. Acceptance of Terms

By creating an account, accessing, or using the Tripilot website and mobile application (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

Tripilot is an AI-powered travel assistant designed to assist travelers in planning trips and making reservations in China. Important Notice: While our AI strives for accuracy, it may occasionally provide incorrect or outdated information. You acknowledge that the AI Agent serves as an assistant, not a definitive authority.

3. User Accounts & Responsibilities

  • Account Security: You are responsible for maintaining the confidentiality of your login credentials.
  • True Information: You agree to provide accurate, current, and complete information (including real names and passport details) as required for travel bookings.
  • Compliance with Laws: You agree to comply with all local laws and regulations applicable to your travel in China.

4. AI Services & Disclaimers

  • No Guarantee of Accuracy: The AI responses are generated based on available data and Large Language Models. We do not guarantee the completeness or 100% accuracy of AI-generated itineraries, translations, or advice.
  • Not Professional Advice: The Service does not constitute legal, medical, or official immigration advice. Always verify visa requirements with official embassies.
  • User Discretion: You are solely responsible for verifying critical information (e.g., flight times, gate numbers, visa policies) before taking action.

5. Booking & Travel Services

When you use Tripilot to book flights, hotels, or tickets, we act as an intermediary/agent between you and the Service Providers (Airlines, Hotels, Railway Operators).

  • Supplier Terms: Your bookings are also subject to the terms and conditions of the specific Service Providers (e.g., an airline's carriage contract).
  • Pricing: Prices for travel products are dynamic. The price is not guaranteed until the booking is confirmed and paid for.
  • Cancellations & Changes:
    • Cancellation policies vary by supplier. You agree to pay any cancellation or change fees charged by the Service Provider.
    • Tripilot may charge a service fee for processing cancellations/modifications, which will be disclosed to you.

6. Travel Documents (Passports & Visas)

  • User Responsibility: It is solely your responsibility to ensure you possess valid travel documents, including a passport (usually with at least 6 months validity) and a valid Chinese Visa or eligibility for the 144-hour visa-free transit policy.
  • No Liability: Tripilot is not liable if you are refused entry onto a flight or into a country due to your failure to carry the correct and valid documents.

7. Payments

  • Authorization: You authorize us (and our third-party payment processors) to charge your designated payment method for the total amount of your purchase.
  • Currency: Transactions may be processed in CNY/USD. Your bank may charge currency conversion fees, for which we are not responsible.

8. Prohibited Activities

You agree not to:

  • Use the Service for any illegal purpose.
  • Attempt to "jailbreak" or trick the AI into generating harmful content.
  • Use any automated means (bots, scrapers) to access the Service.
  • Make false or fraudulent bookings.

9. Limitation of Liability

PLEASE READ CAREFULLY. TO THE FULLEST EXTENT PERMITTED BY LAW:

Tripilot SHALL NOT BE LIABLE for any indirect, incidental, special, consequential, or punitive damages.

We are not liable for any loss or damage arising from:

  • AI Errors: Inaccuracies in AI-generated content.
  • Travel Disruptions: Flight delays, cancellations, lost luggage, or accidents caused by third-party Service Providers.
  • Force Majeure: Events beyond our control (e.g., natural disasters, pandemics, government restrictions).

Our total liability to you for any claim arising out of the service shall not exceed the amount you paid to us for the specific booking or service fee in the 12 months preceding the claim.

10. Intellectual Property

The Service, including its "Vibe Coding" architecture, design, text, graphics, and AI prompt engineering, is the property of Tripilot, Inc. and is protected by copyright and intellectual property laws.

11. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

12. Governing Law & Dispute Resolution

  • Governing Law: These Terms shall be governed by the laws of the People's Republic of China.
  • Dispute Resolution: Any disputes arising out of these Terms shall be resolved through binding arbitration, rather than in court.

13. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after any changes constitutes your acceptance of the new Terms.
